Maya Forstater, a British business and international development researcher won three claims in the Tribunal Appeal, which was announced on July 6, Wednesday.

She lost her job at the think tank Center for Global Development (CGD) in March 2019 after challenging government plans to allow people to declare their gender in a series of tweets that Twitter later deleted for violating their guidelines.

Her company did not renew Forstater’s consulting agreement with CGD in 2019 due to her social media posts referring to transgender women as men during an online discussion on proposed Gender Recognition Act reforms, which alarmed CGD staff.

At the Central London Employment Tribunal, Forstater contested the non-renewal of her contract.

The Employment Appeal Tribunal mentioned that gender-critical beliefs are protected as a belief under the Equality Act 2010; however, the Tribunal made it clear in its ruling that this finding does not imply that those who hold gender-critical views can express them in a way that is discriminatory toward trans people.

Maya Forstater Wins Three Claims In Fresh Employment Tribunal Appeal

A hearing was held in December 2019 to determine if Forstater’s opinions met the requirements of the Equality Act 2010. They did not, according to Judge Tayler, who decided that her beliefs on gender equality were incompatible with human dignity and the fundamental rights of others.

However, the Employment Appeal Tribunal considered Forstater’s appeal against the ruling in April 2021. The verdict was withheld, and on June 10, 2021, the judgment in her favor was released.

The appeal focused, as did the initial hearing, on whether her ideas qualified as protected beliefs under the Equality Act. According to the judge, Forstater’s ideas were protected, fulfilling the last condition in Grainger plc v. Nicholson.

Judge Andrew Glennie presided over the Employment Tribunal’s full merits hearing, which took place in March 2022. Forstater had been mistreated and intolerance by CGD because of her ideas on gender equality.

She had been discriminated against because of her gender-critical opinions, according to the Tribunal’s ruling, which was issued in July 2022 after hearing the complete merits of the case.
